1. Heard learned counsel for the petitioners and learned counsel for the respondents.

The petitioners have filed the instant application for the following reliefs :- "1. i) For issuance of appropriate writ in the nature of Mandamus commanding the respondents to re-fix the pay scale of the petitioners in the scale of 4000-6000 as a 1st ACP in the scale of ASI/Hawaldar and to grant the benefit of MACP which is being paid to the petitioners in the scale by 4000-6000 in place of pay scale of 3200-4900.
ii) To declare and hold that the petitioners falls under the literate cadre and accordingly, they are entilted to get 1st ACP/MACP in the scale 4000-6000 against the post of ASI/Hawaldar and the 2nd ACP/MACP in the scale of 5500-9000 against the post of S.I. iii) To grant the same benefits as the applicant of LPA No. 458 of 2021 because all these petitioners have also been similarly appointed between the years 1996 to 1998 except the petitioner no. 10, who is appointed in the year 1996.
iv) And to grant any other relief/relief(s) for which the petitioners are found
10/11 entitled in the facts and circumstances of the case."

At the outset it is submitted by learned counsel for the petitioners that the case of the petitioners is covered by the judgment of the Division Bench dated 26.4.2024 passed in LPA no.458 of 2021 (Srikant Dubey @ Shri Kant Dubey & Ors. vs. The State of Bihar & Ors.). As such it is prayed that the instant application be disposed of giving liberty to the petitioners to approach the respective Commandants of the area where the petitioners are posted for them to decide the representation/application of the petitioners for the reliefs prayed for herein, in accordance with law.

Having heard learned counsel for the parties and having perused the contents of the petition, in view of the submissions made, the writ application stands disposed of directing that the petitioners shall file their individual/separate representations before their respective Commandants, who shall decide the same in accordance with law also taking into consideration the judgments of this Court which shall be brought on record by the petitioners.
5. The representations shall be filed by the petitioners within a period of 4 weeks which shall be decided by the respective respondents within a period of 3 months from the
11/11 date of its filing.
6. In case the respondents find favour in the representations filed by the petitioners, the consequential benefits shall also be paid to the petitioners within a period of 1 month from the date of passing of the respective orders.
7. It is made clear that the Court has not entered into the merits of the case of the parties which is to be considered by the respective respondents.
8. The writ application stands disposed of.
