JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-08-2016 By filing this writ application, petitioner prays for payment of his retiral dues.
The petitioner was appointed as Stenographer in the year 1983 in Zila Parishad, Samastipur. He retired from the said post on 31.01.2014.
Learned counsel submits that he has been paid only part of his retiral dues.
A detailed counter affidavit has been filed on behalf of the Zila Parishad as well as on behalf of the State of Bihar. The Zila Parishad, in its counter affidavit, has annexed a chart
Patna High Court CWJC No.10628 of 2014 (2) dt.20-08-2016 2/2 containing Annexure-D, stating that the amount payable to the petitioner comes to Rs.19,42,814/-. Learned counsel appearing for the Zila Parishad submits that the Parishad has limited resource, which depends upon the fund allocated by the Government from time to time. They are making payments as per the scheme framed by the Zila Parishad. Learned counsel submits that as per the scheme, petitioner too have been paid 40% of the retiral dues. He further submits that as soon as further fund is allocated not only the petitioner but other employees too would be paid their retiral dues.
In view of the aforesaid assurance given by the Zila Parishad, the writ application is disposed of. (Samarendra Pratap Singh, J.) kunal/- U
