The petitioner seeks bail in Kudwa Chainpur P.S. Case No. 3 of 2017 instituted for the offence under Section(s) 272, 273 of the Indian Penal Code, 30 (a), 37 (a) of the Bihar Prohibition and Excise Act, 2016.

As per the written report, total 210 bottles of Nepali Saufi were recovered from the possession of one Santosh Rai, who disclosed that he is carrying the said liquor for this petitioner. In this manner, there is no recovery from the possession of the petitioner.

Therefore, prayer of the petitioner for grant of bail

Patna High Court Cr.Misc. No.24203 of 2017 (2) dt.22-05-2017 2/2 is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Sikarahna at Dhaka, East Champaran in connection with Kundwachainpur P.S. Case No. 3 of 2017, subject to the condition that both the bailors shall be the close relative of the petitioner.
