2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1), 61(2), 351(2) and 3(5) of the BNS and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with other co-accused persons and 6 unknown persons came at the house of the informant and opened fire upon the informant's husband from desi katta due to which he died on way to hospital.

4. Learned counsel for the petitioner submits that six persons are alleged to have shot fire upon the husband of the informant but the deceased sustained only one injury. Informant is not an eye witness of the occurrence. Similarly situated other

Patna High Court CR. MISC. No.53908 of 2025(3) dt.20-11-2025 2/2 co-accused person has already been granted regular bail by a coordinate Bench of this Court vide order dated 12.02.2025 passed in Cr. Misc. No. 1349 of 2025. Petitioner is in custody since 05.08.2024.

5. Learned counsel for the informant vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge-First, Patna in connection with S. Tr. no. 1013 of 2025 arising out of Ram Krishna Nagar P. S. Case No. 597 of 2024.
