The petitioner seeks regular bail in connection with Rail P.S. DBN (SMI) Case No. 08 of 2017 dated 03.02.2017, registered for the offence punishable under Sections 370/34 of the Indian Penal Code and Section 79 of the Juvenile Justice Act. The allegation against the petitioner is that while he was travelling in the train, taking children along with him for employing them as labourers, the police had conducted a raid and recovered the said children who are said to have been travelling with the petitioner.
The learned counsel for the petitioner submits that the children were travelling separately in the said compartment of the train. It has been further submitted that the petitioner has no
Patna High Court Cr.Misc. No.22844 of 2017 (3) dt.14-06-2017 2/2 criminal antecedent and he is in custody since 04.02.2017. It is further submitted by the learned counsel for the petitioner that similarly situated co-accused persons have been granted bail by this Court by orders dated 04.05.2017 and 11.05.2017 passed in Cr. Misc. No.17059 of 2017 and 20140 of 2017, respectively. Having regard to the facts and circumstances of the case, more particularly the fact that the aforesaid co-accused persons, similarly situated to the petitioner herein, have been granted bail by this Court, I deem it fit and appropriate to enlarge the petitioner on bail.
Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway, Samastipur in connection with Rail P.S. DBN (SMI) Case No. 8 of 2017.
