2. Permission is accorded.
3 . This bail petition of petitioner No. 2 is dismissed as withdrawn .
4. Heard learned counsel for the petitioner Nos. 1 , 3 and 4 and the State .
5 . Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ),
Patna High Court CR. MISC. No.54281 of 2025(2) dt.27-08-2025 2/3 115 ( 2 ), 303 ( 2 ), 87, 95 , 81 , 82 and 61 ( 2 ) of the BNS 2023 .
6. The prosecution case in brief, is that informant Manish Kumar alleged that on 30.07.2024 , his wife (petitioner No. 1) namely , Kajal Kumari took away his eight years old minor daughter and also took away jewellery of worth rupees Three lakhs and cash of rupees Thirty thousand. It is further alleged that informant suspects that parents of petitioner No. 1 (wife of informant) have taken away his wife and minor daughter, for the purpose of performing second marriage of his wife Kajal Kumari (petitioner No. 1) . It is further alleged that after 5 days , informant along with some villagers went to Sonapur Bharath to inquire about his wife and minor daughter where all the accused persons assaulted him and took out rupees five thousand from him and also threatened with dire consequences. It is further alleged that informant came to know that accused persons have disappeared his minor daughter.
7. It is submitted on behalf of the petitioners that petitioner No. 1 is wife of informant, petitioner Nos. 3 and 4 are brother-in -law of informant. Present case has been instituted to put pressure upon petitioners side to settle the matrimonial dispute between the parties. During investigation , the victim
Patna High Court CR. MISC. No.54281 of 2025(2) dt.27-08-2025 3/3 minor daughter of informant was recovered and victim in her statement recorded under section 183 BNSS stated that she went to her Nani ghar with her mother and no one kidnapped her. Petitioners claim clean antecedent.
8 . Learned counsel for the State oppose the bail petition .
9. Considering the 183 BNSS statement of victim , clean antecedents of these petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner Nos. 1 , 3 and 4 as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Manjhaul in connection with Manjhaul P.S. Case No. 100 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
