The petitioner is accused in connection with Mohania P.S. Case No. 45 of 2017 registered under Section 364 of the Indian Penal Code.

The accusation of the informant is that on 14.01.2017 his son Narayan Kumar left his house, but did not return. The informant made suspicion against the petitioner about the kidnapping of his son, as the petitioner was threatening that he will not leave the informant in peace.

Learned counsel appearing on behalf of the petitioner submits that as per the F.I.R., major son of the informant left his house in the evening on 14.01.2017, but did not return regarding

Patna High Court Cr.Misc. No.23208 of 2017 (2) dt.18-05-2017 which he informed to the Police Station on 15.01.2017, on which basis, Sanha was registered. Thereafter, the petitioner gave his written report on 01.02.2017 on the basis of the F.I.R. registered mere on suspicion. It is further submitted that petitioner has no criminal antecedent and he is in custody since 09.02.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 45 of 2017, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner.
