2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302, 120B and 34 of the Indian Penal Code.

3. As per prosecution case, all the FIR named accused persons including this petitioner killed husband of the informant by cutting his neck.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Informant is not eye witness of the occurrence. Learned counsel submits that save and except suspicion, there is no other direct or indirect evidence against the petitioner to show his complicity in the occurrence. Petitioner claims clean antecedent. Co-accused,

Patna High Court CR. MISC. No.56568 of 2025(4) dt.04-11-2025 2/2 with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 36606/2025. Petitioner is in custody since 2.5.2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the nature of accusation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge IX, Kaimur at Bhabua in Ramgarh Police Station Case No. 100 of 2024.
