====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 04-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with S. Tr. No. 119 of 2024 arising out of Bagengola P.S. Case No. 123 of 2023, lodged on 14.12.2023, under Sections 302 and 201 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against six named accused persons including the present petitioner against whom there is allegation that all in connivance with each other have killed the informant's daughter.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the marriage of the petitioner with deceased was solemnized 14 years back. Counsel submits that the petitioner's wife died natural death but due to emotional distress and the

No.57916 of 2024(3) dt.04-09-2024 2/2 influence of co-villagers, the informant filed this case and upon realising the same the informant has filed application in the form of an affidavit before the Chief Judicial Magistrate on 29.01.2024, indicating the entire situation that due to wrong information he has filed this case. Counsel further submits that criminal antecedent of the petitioner is clean and he is in custody since 12.01.2024.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that in the FIR there is direct allegation against the present petitioner.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Buxar, in connection with S. Tr. No. 119 of 2024 arising out of Bagengola P.S. Case No. 123 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure. (Dr. Anshuman, J.)
