The petitioners apprehend their arrest in a case registered for the offence under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.

As per the prosecution case, all the F.I.R. named accused persons, including these petitioners, cheated Rs. 10,00,000/- (ten lacs) from the informant in lieu of providing a piece of land to her, but neither any land was registered in her favour nor alleged money was returned to her. It is submitted on behalf of petitioners that no such occurrence, as alleged in the F.I.R., has ever occurred and said land was already executed in favour of informant on 15.03.2021 and after about three months, she has lodged this case only with a view to humiliate and harass the petitioners. Petitioners have got clean antecedent.

Patna High Court CR. MISC. No.55273 of 2022(2) dt.22-12-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur in connection with Baruraj P.S. Case No. 94 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
