No one appears on behalf of the State.
The petitioner are the father-in-law and mother-in-law respectively of the informant and are facing prosecution under section 498-A/34 IPC. They seek anticipatory bail. It is submitted that the petitioners are aged persons and they were shocked as their only son (husband of the informant) had died in course of treatment in Chandigarh. On perusal of the impugned order, it appears that on a consideration of the submission made by the petitioners the learned Sessions Judge had granted anticipatory bail to them on 22.01.2015. The petitioners defied the said order inasmuch as
Patna High Court Cr.Misc. No.23834 of 2017 (2) dt.06-07-2017 2/2 they did not surrender. At least one year thereafter they made a prayer for modification/extension of time which has been refused by the learned Sessions Judge.
Upon hearing the counsel for the petitioners, this Court is not persuaded to grant anticipatory bail to the petitioners. The petitioners shall surrender and pray for regular bail which shall be considered and disposed of on its own merit by the learned court below unprejudiced by the present order. The application stands disposed of.
