2. Petitioner seeks regular bail in connection with Bariyarpur P. S. Case No. 247 of 2024 in a case registered for the offences punishable under Sections 103(1) of the Bharatiya Nyaya Sanhita as well as Section 302 of the Indian Penal Code.
3. As per prosecution case, some unknown persons committed murder of the mother of informant while she had gone out for work.
4. Learned counsel for the petitioner submits that F.I.R. is lodged against unknown. Name of the petitioner transpired during course of investigation. No one has claimed to have seen this petitioner committing the offence. Only material that has come during course of investigation is that in CCTV
Patna High Court CR. MISC. No.66112 of 2025(4) dt.11-11-2025 2/2 footage this petitioner was seen at the place of occurrence within 10 minutes of the arrival of the victim on the spot. Petitioner is in custody since 15.12.2024. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Munger in connection with Bariyarpur P.
