Though, pursuant to order dated 09.10.2015 a counter affidavit had to be filed in terms of the said order showing payment to the petitioner which has not been done, but learned counsel for the respondent Corporation has produced a copy of letter of the Deputy Chief Accounts Officer of the Corporation dated 29.10.2015 which indicates that payments have been made to the petitioner relating to Gratuity and unutilized leave as well as Provident Fund. It is submitted that as per the scheme of the Corporation, payments have been made in a uniform basis to all the employees including the petitioner.

In view of the aforesaid, the writ application stands

Patna High Court CWJC No.15561 of 2012 dt.02-12-2015 disposed off. However, the respondent Corporation shall ensure that in future also if anything is to be paid to the petitioner as per uniform policy and scheme of the Corporation, the same shall be paid to him without any discrimination.
