JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 18-08-2018 The present writ petition has been filed for a direction to the respondents to allot the new shops of Public Distribution System (PDS) to the petitioner who comes from B.C. community of whose majority in the Gram Panchayat Malattih, P.S. and Anchal Shambhuganj, District Banka.

2. Learned counsel for the petitioner submits that an advertisement dated 04.08.2015 has been published in respect of allotment of new shops of Public Distribution System. The petitioner claims to be from the B.C. community which is the majority of the Gram Panchayat Malattih. It is submitted that of the five PDS shops in the said Gram Panchayat Malattih, two shops of B.C. category were vacant. It is submitted that the petitioner's application was not accepted on the

3. Learned counsel for the respondents appears and has been heard.

This Court takes note that the petitioner has rushed to this Court without however, approaching the concerned respondents with his claim for allotment of PDS shop and for redressal of his grievance. Accordingly, the ends of justice will be met if the petitioner is granted liberty to file a fresh representation before the Sub Divisional Officer, Banka (Respondent No. 6) for redressal of his grievances. If any such representation is filed within a period of two weeks from today, the same shall be considered and disposed of after grant of opportunity of hearing to the petitioner, expeditiously and preferably within a further period of eight weeks thereafter in accordance with law.
