The petitioners seek bail in Pipra P.S. Case No. 116 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code.

The petitioners are not named in the FIR. It is submitted that during course of investigation one Md. Sarfaraj Akhatar @ Gudd was arrested and he is said to have confessed his guilt. Save and except the confession of Md. Sarfaraj Akhatar @ Gudd there is no tangible material against the petitioners. Learned APP did not dispute this fact.

Considering the facts aforesaid the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like

Patna High Court Cr.Misc. No.22315 of 2017 (3) dt.29-06-2017 2/2 amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Supaul in Pipra P.S. Case No. 116 of 2016.
