JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-04-2024 The present writ petition has been filed seeking the following relief:- "(i) To issue an appropriate order/s, direction including a writ preferably in the nature of CERTOPRARI for quashing the order dated 0107-2023 passed in Anganbari Case No. 02 of 2017-18 passed by the District Magistratecum-Collector, Muzaffarpur whereby and whereunder he has dismissed the appeal

Patna High Court CWJC No.12373 of 2023(2) dt.22-04-2024 2/3 preferred by the petitioner and cancelled the appointment of petitioner who was working to the post of Anganbari Sevika in Anganbari Centre No.228 under Ward N.03 of Village Panchayat- Jogni Ganga, within Sakra Block in the District of Muzaffarpur.

(ii) To direct the respondent District Magistrate-cum- Collector to restore the order as contained in memo No. 578/ dated 13-1216 directing he Child Development Project Officer, Sakra to issue selection letter to the petitioner to the post of Anganbari Sevika for the above-mentioned centre, (iii) To direct the respondent Child Development Project Officer, Sakra to reinstate the petitioner hence forth with to the post in question."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.
