5. Learned counsel for the respective parties on instruction submitted that the present matter is similar to L.P.A. No. 891 of 2019 decided on 22.08.2022 in the case of Ajit Kumar Singh Vs State of Bihar & Ors.

6. Taking note of aforementioned submission, the present L.P.A. No. 889 of 2019 stands disposed of in terms of order dated 22.08.2022 passed in L.P.A. No. 891 of 2019 arising out of C.W.J.C. No. 2589 of 2019.
