JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 366A/120B/34of the Indian Penal Code and Section 66A of the Information Technology (Amendment) Act, 2008.

Allegation against the petitioner is that he induced the daughter of the informant to go with him and, as such, committed kidnapping. The victim girl in her statement under Section 164 Cr.P.C. stated that she had voluntarily gone with coaccused Mukesh Kewat and was residing with him for a month. Thereafter, parents came to know and she was brought back. Considering the statement of the victim girl, the matter appears to be of love affairs, let petitioner,

Patna High Court Cr.Misc. No.30301 of 2017 (2) dt.11-07-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, ////Successor Court, in connection with // P.S. Case No.//, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
