In this case, the petitioner is apprehending his arrest in connection with Narayanpur P.S. Case No. 31 of 2017 registered for offences under sections 304(B)/34 of the Indian Penal Code.
As per allegation made in the First Information Report, Rinku Devi, the victim girl, was married to Birendra Singh on 15.5.2017, on account of demand of dowry, the victim was killed on 25.7.2017 i.e. just after two months of marriage. An allegation has been made that the accused persons have killed her by strangulation and disposed of the body on the same night itself.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.26787 of 2018(2) dt.03-05-2018 2/2 petitioner is the elder brother of the father-in-law of the deceased having no relationship with the family of the husband of the victim girl. He has further submitted that the petitioner is 73 years old and is suffering from different ailments. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Parmeshawar Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Ara, Bhojpur in connection with Narayanpur P.S. Case No. 31 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
