Heard learned counsel for the petitioner and the State. The petitioner prays for grant of anticipatory bail in Gopalpur P.S. Case No. 60/2014 registered for the offence punishable under Sections 302/201/120(B)/34 of the Indian Penal Code.

The co-accused Tufani had also moved earlier in this court and his prayer for grant of anticipatory bail has been rejected. The petitioner along with Tufani and others are said to have tortured the deceased and killed him.

There is no reason to distinguish the case of the petitioner from that of co-accused Tufani.

The court below is directed to consider the regular bail of the petitioner without being prejudiced by the fact that his anticipatory bail application has been dismissed by this Court.
