JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a)/36/41(1) of Bihar Prohibition and Excise (Amendment) Act, 2018.

As per prosecution case, 883.040 liters of India made foreign liquor was recovered from a vehicle.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner is neither driver nor owner of the vehicle in question. Nothing has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail submitting that the petitioner has got 6 criminal antecedents

Patna High Court CR. MISC. No.58769 of 2022(3) dt.09-12-2022 2/2 of similar nature.

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
