Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 30.07.2021, charge-sheet has been submitted and has antecedent of one case.
The informant alleges that on 26.06.2020, at about 07:45 p.m., he proceeded to his house after collecting outstanding amount of Rs.1,50,000/- by his vehicle. It is further alleged that while the informant was coming back to his home along with the money, he was intercepted by two miscreants who looted his motorcycle along with his gold chain, mobile

Learned counsel for the petitioner submits that the FIR is against unknown. The name of this petitioner transpired in the confessional statement of co-accused Pramod Kumar Sahni who was arrested in Saraiya P.S. Case No. 280 of 2020. It is further submitted that no incriminating article was recovered from the possession of the petitioner nor this petitioner has been put on T.I. Parade. It is further submitted that petitioner was also arrested in Saraiya P.S. Case No. 457 of 2021 in which he was made to confess his participation in the present crime based on the confessional statement of Pramod Kumar Sahni. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 30.07.2021, charge-sheet has been submitted and coaccused Arun Sahani has been granted bail by order dated 06.12.2021 in Cr. Misc. No. 36525 of 2021, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saraiya P.S. Case No. 414 of 2020, subject to the condition that
