2. Mr. Sanjay Kumar Singh, learned counsel appearing for the petitioner submits that the instant petition has been filed for the relief of Provisional Bail to the petitioner for 15 days (fifteen days) on the ground of requirement of urgent medical attention to his son. It is further submitted that the same kind of relief was earlier also granted to the petitioner by way of Cr. Misc. No. 75339 of 2023 vide order dated 10.11.2023 and thereafter, the petitioner surrendered within the prescribed time and also filed surrender slip and now, he has again come before this Court to get the relief of Provisional Bail as the health of his son is not good and the same is deteriorating day by day and there is urgent need of medical treatment to his son. No.61039 of 2024(2) dt.06-09-2024 2/3 submitted that the petitioner is the only male person in his family to make the necessary arrangements for medical treatment of his son who is suffering from neuro disease. It is further submitted that petitioner's son is suffering from mental disease for several years and his treatment is going on at various hospitals at different places and in the present time, he has been referred to the Department of Neurology, Patna Medical College and Hospital.
3. Considering the above submissions, this Court is inclined to accept the petitioner's prayer for Provisional Bail for a period of 15 days (fifteen days). Accordingly, let the petitioner named-above be released on Provisional Bail for a period of 15 days (fifteen days) from the date of this order on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Lachhuar P.S. Case No. 02 of 2021 corresponding to Sessions Trial No. 168A/2022 with further condition that both the bailors shall be the close family members of the petitioner.
4. The petitioner shall surrender on or before 21.09.2024 before the trial court and thereafter, file surrender certificate/slip in this Court before the next date.
