JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 22.03.2017 in connection with Bind P.S. Case No. 96/2016 for the offences instituted under Sections 304(B) and 201/34 of the IPC. The prosecution story, in brief, is that the accused persons killed the sister of the informant due to non-fulfilment of dowry demand.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.03.2017. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner is the brother-in-law (Dewar) of the deceased. He is separate in mess and property from the husband of the deceased.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Bind P.S.
