2. The petitioner who claimed to be son of the erstwhile employee has approached this Court seeking a direction upon the respondent authorities to pay the arrears of family pension and other benefits.

Learned Advocate for the petitioner informed this Court that the father of the petitioner was a Class-III employee in the office of the Deputy Director, Survey Office Gulzarbag, Patna, who superannuated long back on 01.02.1996 and died on 01.06.2022 leaving behind his wife Ratna Devi. Immediately after death of the erstwhile employee, his wife, who happens to

Patna High Court CWJC No.12235 of 2024(2) dt.18-06-2025 2/3 be mother of the petitioner filed an application for payment of family pension; however, the same could not be extended in her favour. In the meanwhile, the mother of the petitioner also died on 25.02.2023. In the aforesaid premise, the petitioner filed an application before the concerned authority for payment of arrears of pension and family pension but to no avail; hence, the present writ petition.

Mr. Manoj Kumar Ambastha, learned Advocate for the State referring to the averments made in the counter affidavit has categorically stated that twice letters have been sent to the petitioner; firstly on 20.09.2024 and further on 19.10.2024 to furnish necessary relevant document(s) so that arrears of pension/family pension could be extended but till date it appears that he has not even approached the office of the concerned authorities.

5. In view of the submissions advanced and taking note of the limited grievance of the petitioner, this Court deems it fit and proper to dispose off the writ petition with a liberty to the petitioner to approach before the respondent no.2.

6. In case, the petitioner approached before the respondent no.2, preferably within a period of four weeks from today along with the necessary documents as has been asked for

Patna High Court CWJC No.12235 of 2024(2) dt.18-06-2025 3/3 by the afore-noted letters dated 20.09.2024 and 19.10.2024, the concerned respondent shall look into the matter and pass necessary order(s) and ensure payment of remaining admissible arrears of pension/family pension to the petitioner within a further period of twelve weeks, in accordance with law.

7. The writ petition stands disposed off.
