NILU AGRAWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody since 22.03.2017 in connection with Motihari Town P.S. Case No. 98/16, corresponding to G.R. No. 527/16, for offences punishable under Sections 341, 323, 504, 379, 384, 354/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that on account of transfer of property, the petitioner along with other accused has forced her to put her thumb impression on the stamp paper and also assaulted her.

It has been submitted by the learned counsel for

Patna High Court Cr.Misc. No.23311 of 2017 (3) dt.22-06-2017 2/2 the petitioner that he is innocent, suffers 75% disability and is a student of B.A. Hons. It is submitted that both sides are relatives, the informant is the bhabhi of the petitioner and on account of quarrel and on inimical terms Town P.S. Case No. 02/16 had earlier been instituted. It is further submitted that the matter relates to property dispute.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case No. 98/16, corresponding to G.R. No. 527/16.
