In the present case, the petitioner was proceeded departmentally for the misconduct, the Enquiry Officer found the charges proved against him, the enquiry report was served and after receipt of the comments, the final order was passed against the petitioner.
In the counter affidavit, it has been mentioned that there is appellate forum and without exhausting the same, the petitioner has directly moved before this Court.
Patna High Court CWJC No.17331 of 2010 dt.11-01-2018 In view of the stand taken by the State in the counter affidavit, let the petitioner should exhaust alternative remedy before the appellate authority and if the order goes against him, he will be at liberty to take legal course as is available in law. With the aforementioned observations, this writ application is disposed of.
