The petitioner apprehends his arrest in connection with Majhauliya P.S. Case No. 103 of 2025 instituted for the offence under Sections 329(3), 126(2), 115(2), 118, 109, 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is that on 03.02.2025 at around 6:00 PM, following a prior dispute, several accused persons including petitioners came armed to the informant's house. It is specifically alleged that petitioner Nos. 1 & 3 assaulted the informant's mother by grabbing her hair.

It has been further submitted by the petitioner's counsel that petitioners have been falsely implicated in the present case. Referring to impugned order, it would reveal that mother of the informant has not sustained any injury over her head, which falsify the allegation against the petitioner Nos. 1 &
3. There is no specific allegation attributed to petitioner No.2, rather the same is general and omnibus in nature. Police after completion of investigation has submitted charge sheet in this case. Petitioner Nos. 1 & 2 have no criminal antecedent, whereas petitioner No.3 bears one criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 09-07-2025, passed in Cr. Misc. No. 40941 of 2025. 5.
On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteeen Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where
