2. None appears on behalf of the petitioner despite call being repeated after an interval.

3. Learned counsel for the respondents invites reference to paragraph 4 of the counter affidavit, according to which the admitted amount of Rs. 4,00,000/- has been paid to the petitioner vide cheque no. 169655 dated 10.12.2013 drawn from U.B.G.B. Bank, Purnea and the remaining amount of Rs. 49,420/- is said to have been

4. Having regard to the nature of the grievance of the petitioner and the stand of the respondents in the counter affidavit, this Court is not inclined to interfere in the matter. The statement made in the counter affidavit with regard to excess claim of Rs. 49,420/- by the petitioner has not been controverted and no rejoinder thereto has been filed.
