The petitioner seeks bail in Rahika Phulparas P.S. Case No. 558 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while the informant was returning home from shop, on the way petitioner along with other accused persons fired at him causing gunshot injury at his Panjara and chest.

It is submitted on behalf of the petitioner that there is general and omnibus allegation and no specific overt act has been raised against this petitioner. Though petitioner is named in

Patna High Court CR. MISC. No.64965 of 2021(3) dt.15-04-2022 2/2 the FIR, but informant did not disclose that as who fired at him Petitioner is in custody since 16.02.2021.

Learned APP however, vehemently opposed the prayer for bail and submitted that there is direct and specific allegation of causing gunshot injury and petitioner is having criminal antecedent.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
