The petitioners are working as Non-formal Instructors, but after the abolition of non-formal instructions the petitioners are claiming the absorption in the services of the State Government either in class-III or in Class-IV post.
Similar issue came for consideration before this Court in C.W.J.C. No. 8418 of 2010, which has allowed vide order dated 21.04.2011 and the same has been confirmed in Letters Patent Appeal No.1489 of 2011. The State has challenged the order of the Division Bench before the Hon'ble Supreme Court in S.L.P. No.3207 of 2015, which has been disposed of with the direction to implement the order of the writ Court, but the Hon'ble Supreme Court has restricted the order to the persons those who have
approached to the High Court.
Learned counsel for the State has not disputed the fact that both the cases are identical in nature.
In such view of the matter, this writ application is disposed of in terms of the order passed in C.W.J.C. No. 8418 of 2010 (Sheo Bhajan Prasad Diwakar and Ors. vs. The State of Bihar and Ors.) At this stage, learned counsel for the State submits that the petitioners of C.W.J.C. No. 8418 of 2010 have been adjusted in Class-IV post. So, the respondents are directed to give the same and similar benefit as has been given to the petitioners of C.W.J.C. No. 8418 of 2010.
