The petitioner seeks bail in a case instituted under Sections 306, 201/34 of the Indian Penal Code. The allegation against the petitioner is that he used to assault and torture the daughter-in-law of Phuldeo Mahto and due to that reason, she committed suicide by taking pesticide. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case of suicide. The allegation of suicide has not been supported by the father of the

Patna High Court Cr.Misc. No.23432 of 2017 (2) dt.23-05-2017 2/2 deceased. The petitioner has been made accused due to village politics. The case has not been instituted by the family members of the deceased rather it has been instituted by the local chowkidar. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhubani in connection with Raj Nagar P.S. Case No. 76 of 2004.
