Petitioner seeks bail in Charpokhari P.S. Case No. 191 of 2019 registered for the offence punishable under Sections 307, 506/34 of the Indian Penal Code, Section 66 of I.T. Act and Sections 27/35 of Arms Act.

As per the prosecution case, this petitioner alongwith other co-accused persons made indiscriminate firing at a dance party on the eve of birthday celebration of grand-daughter of coaccused Akhilesh Bhatt. Learned counsel appearing for the petitioner submits that through, there is allegation of firing against all the accused persons, but no one has sustained any fire-arm injury. Similarly situated accused Niraj Kumar Bhatt and Misir Yadav have already been granted bail by this Court, vide order dated

Patna High Court CR. MISC. No.64858 of 2021(2) dt.24-02-2022 2/2 30.09.2020 passed in Cr. Misc. No. 25542/2020 and order dated 18.01.2022 passed in Cr.Misc. No. 43167 of 2021 respectively. Petitioner is in custody since 02.09.2021. Investigation is complete.

Learned A.P.P. for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 191 of 2019.
