The petitioner has preferred this application for grant of regular bail in a case registered under section 7 of the E.C. Act.

As per the prosecution case, 46 sacks of 54 kgs each of rice was seized and the driver of the vehicle disclosed the name of the petitioner as being the owner of the same. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The only material against him is the statement of the co-accused made before police. He has no concern with the allegedly seized rice or the vehicle from which it was seized.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R., the petitioner having remained in custody for more than 7 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Chausa (Phulaut) P.S. Case no.62 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura.
