The petitioners seek bail in Sadar P.S. Case No. 355 of 2021, registered for the offence punishable under Sections 420, 384, 386, 354(D), 504/34 of the Indian Penal Code and section 66(A) of the Information Technology Act. As per the prosecution case, these two petitioners are alleged to have sedated the informant and his colleague by intoxicants, took objectionable photographs and sought ransom from the informant. Thereafter, due to non-fulfillment of demand of ransom the petitioners posted photographs on social media.
It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.65454 of 2021(2) dt.24-02-2022 2/2 petitioners are husband and wife and have been falsely implicated in this case. Prosecution case is highly improbable that in presence of wife petitioner no. 1 took objectionable photographs of the informant. There is no tangible evidence against the petitioners and they are they are in custody since 19.07.2021. Investigation is complete.
Counsel for the informant however vehemently opposed the prayer for bail.
Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 355 of 2021.
