JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gopalpur P.S. Case No. 134 of 2016 instituted for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged in the written report filed by the mother of the deceased that four persons along with two unknown have killed her son causing fire-arm injury.
It has been submitted on behalf of the petitioner that his name has come during investigation on the basis of spy and, thereafter, petitioner was arrested and police recorded his confessional statement. Charge sheet has already been submitted in this case. It has further been submitted that Mukul Choudhary
Patna High Court Cr.Misc. No.23703 of 2017 (2) dt.23-05-2017 2/2 and Lootan Sah have already been granted bail by coordinate Benches of this Court vide order dated 25.1.2017 and 20.3.2017 passed in Cr. Misc. 50132 of 2016 and 11353 of 2017 respectively.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Second Additional District & Sessions Judge, Naugachia, Distt. Bhagalpur, in connection with Sessions Trial No. 774 of 2016 arising out of Gopalpur P.S.
