In this case, the petitioners are apprehending their arrest in connection with Majorganj P.S. Case No. 311 of 2017 registered for offences under sections 341, 323, 452, 380, 379, 354, 406, 504, 506/34 of the Indian Penal Code. In the present case, an allegation has been made against Sanjay Paswan and Sunar Paswan of using filthy words against the Informant, pushed her down, caught hold her hairs and, later on, they entered into the house and misbehaved with the Complainant.
So far other accused persons are concerned, there is no specific allegation leveled against them.
Patna High Court Cr.Misc. No.30335 of 2018(2) dt.18-05-2018 2/2 In view of the nature of allegation leveled against the petitioner no. 1, Sanjay Paswan and petitioner no.4. Sunar Paswan, this Court is not inclined to grant privilege of anticipatory bail to them.
Accordingly, the prayer for anticipatory bail of the petitioner nos. 1 & 4, above named, is rejected. There being no specific allegation against the petitioner nos. 2, 3, 5 & 6, namely, Dhanbanti Devi, Laxman Paswan, Kamod Paswan and Samtolia Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Sitamarhi in connection with Majorganj P.S. Case No. 311 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
