JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 47 (a), 53(C), 54 and 57 of the Bihar Excise (Amendment) Act.

About 10 liters of country made liquor was recovered near Shyam Bazar from where on seeing the police party petitioner tried to flee away.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and he has falsely been implicated in this case. He is in custody since 25.09.2016.

Considering the aforesaid facts as well as the period of incarceration, let petitioner, above named, be enlarged on bail

Patna High Court Cr.Misc. No.24200 of 2017 (2) dt.19-05-2017 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Banka in connection with Baunsi P.S. Case No.184 of 2016.
