Petitioner apprehends his arrest in Barauni Chakiya P.S. case no. 410 of 2017 instituted for the offence under Section(s) 364/34 of the Indian Penal Code.

It is alleged in the written report that this petitioner with other accused persons have kidnapped the father of the informant.

The case diary has been received in this case. Learned counsel for the State after looking into the case diary submits that father of informant is still traceless. Learned counsel for the petitioner has submitted on 28.6.18, that father of the informant has been traced out and was directed by this Court to file supplementary affidavit. But till

Patna High Court Cr.Misc. No.30163 of 2018(5) dt.19-07-2018 2/2 date no supplementary affidavit has been filed. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
