The petitioner is apprehending his arrest in connection with Sasaram Town (Darigaon) P.S. Case No. 377 of 2018, registered for the offences punishable under Sections 8(b)/18 of the N.D.P.S.Act.
Allegation against the petitioner is of recovery of ten plants of opium.
Submission of learned counsel for the petitioner is that the said recovered plants are not opium, rather the said recovered trees are of Posta which is in vogue of general people. Further submission is that apprehended co-accused has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 04.07.2018 passed in Cr.Misc. No.28018 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within six weeks from today and pray for regular bail which shall be considered on the same day on its own merit considering the fact that another co-accused has already been granted regular bail, without being prejudiced by this order. With the aforesaid observation, this application is disposed of.
