Petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b), a, 26(2) 35 of the Arms Act. Allegation against the petitioner is recovery of one country made pistol and other incriminating materials from his possession.

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere suspicion. The finding recorded by learned Additional Sessions Judge-III, Begusarai, that petitioner has got two criminal antecedents has been controverted by learned counsel for the petitioner stating that petitioner has got only one criminal antecedent. Petitioner is in custody since 21.12.2020.

No.65423 of 2021(2) dt.11-04-2022 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Town P.S. Case No. 715 of 2020, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
