Appeal No.433 of 2011, which stood dismissed in default on 20.06.2014. It is pointed out by the petitioner that Mr. Shiva Shankar Sharma, Advocate was representing the appellant but on account of demise of his close relative, he suddenly proceeded to the village to attend the funeral ceremony.

The present application for restoration was filed soon thereafter on 26th June, 2014.

Keeping in view the circumstances explained in the application, we deem it appropriate to allow the present application and restore the miscellaneous appeal to its original number.

Patna High Court MJC No.2208 of 2014 (3) dt.10-03-2016 List the appeal after two weeks.
