Heard Mr. Murari Prasad Sinha, learned counsel for the petitioner, Mr. Sunil Kumar Pandey, learned AC to SC 14 for the State and Mr. Abhay Shankar Jha, for the respondent Nos. 3-5. In this case the grievance of the petitioner is that the date of birth recorded in the passport is not correct and although he has approached the appropriate authority who according to the learned counsel for the petitioner would be the Passport Issuing Officer, but the grievance has not been disposed of resulting in filling of

Having heard the learned counsel and considering the nature of grievance, I deem it fit and proper to dispose of the writ petition with liberty to the petitioner to file a proper application before the Passport Issuing Officer or the authority concerned enclosing the documents certifying his death of birth and it goes without saying, that any such application filed by the petitioner for alteration of his death birth would be considered by the Passport Officer or the authority concerned and be disposed of in accordance with law with opportunity of hearing to the petitioner expeditiously and preferably within six months from the date of receipt/production of a copy of this order.
