JUSTICE SANJAY PRIYA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Roh P.S. Case No. 58 of 2016 instituted for the offence under Sections-25(i-b)a/26/35 of the Arms Act.
It is alleged in the written report that on getting information that some body has been shot, police reached at the place of occurrence. It is alleged that Pramod Gupta having sustained fire arm injury, was taken to PHC, Roh for treatment and from there, he was referred to Sadar Hospital. Two persons were caught by the crowd and both of them sustained injury. When the crowd made search of this petitioner, one loaded country-made pistol and one empty cartridge has been recovered from his possession.

Learned APP submitted that name of this petitioner has been disclosed by co accused Pramod Kumar before the police. Counsel for the State has further submitted that this petitioner having armed with fire-arms, was apprehended on the spot by the crowd.
Counsel for the petitioner has submitted that there is no eye witness to allege that the petitioner has made firing on the injured. The petitioner is in custody since 02-09-2016. Considering the above facts and circumstances, the prayer for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Roh P.S. Case No. 58 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Nawada subject to condition that both the bailors should be close relatives of the petitioner.
