JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-05-2018 This is the second attempt for grant of pre-arrest bail in connection with Complaint Case No.594 (C) of 2000 in which cognizance has been taken for the offences punishable under Sections 420, 467, 468 and 120B of the Indian Penal Code. Earlier, a similar application filed under Section 438 of the Code of Criminal Procedure by the petitioner was rejected by this Court vide order dated 26.08.2014 passed in Cr. Misc. No.14912 of 2014.

Patna High Court Cr.Misc. No.22523 of 2018 (2) dt.01-05-2018 accused Md. Hasan has already been discharged from the case vide order dated 19.12.2017 by the learned A.C.J.M. as no ground for framing of charge was found against him. In the opinion of this Court, the ground taken for renewal of the application for grant of pre-arrest bail is of no help to the petitioner, as he has never ever appeared before the court after issuance of summons and is evading arrest since more than a decade. No other ground for reconsideration of bail has been argued before this Court.

In that view of the matter, the application for grant of pre-arrest bail is once again rejected.
