JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 324, 307/34 of the Indian Penal Code.

As per allegation in the FIR, during celebrity firing in BARAT ceremony by petitioner and accused Vikash Yadav, two children, namely, Guddu Kumar (10 years) and Dipu Kumar (13 years) received gun shot injuries. During treatment, injured Dipu Kumar died after two months due to gun shot injuries. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. There was no intention or motive behind killing of informant's cousin. Charge has already been framed against the petitioner. Similarly

No.56362 of 2023(3) dt.01-11-2023 2/2 situated other accused person, namely, Vikash Yadav, has already been enlarged on bail by another coordinate Bench of this Court vide order dated 19.07.2023 passed in Cr. Misc. No. 40237 of 2023. Petitioner is languishing in judicial custody since 23.02.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Class, Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 106 of 2021.
