The petitioner is languishing in custody since 09.03.2016 in connection with Sessions Trial No. 401 of 2016, arising out of Khodawandpur P.S. Case No. 23 of 2016 for the offences instituted under Sections 147, 148, 149, 307 and 302/34 of the IPC.
The prosecution story, in brief, is that the informant Ramcharitra Singh, father of the deceased Pankaj Singh that while Pankaj Singh had gone to the shop of Hare Ram Singh to purchase wine, an altercation took place. Pankaj Singh returned back to his house followed by Hare Ram Singh who was joined by his men. Pankaj Singh was caught hold by them, taken to the door of Hare
Patna High Court Cr.Misc. No.19637 of 2017 (3) dt.10-05-2017 2/3 Ram Singh where Ranjit Singh and Anjani Singh began to assault him with wooden particles while remaining were engaged in apprehending him. Subsequently thereof, Pankaj was taken to hospital where he was declared dead.
The earlier bail application of the petitioner was rejected vide Cr. Misc. No. 34032 of 2016 dated 28.09.2016 taking into account that the specific allegation of assault have been made against the petitioner and other co-accused Anjani Singh. The post mortem report has also corroborated the allegation made in the F.I.R.
A report was called for from the court below regarding the stage of the case. It has been reported that out of 08 prosecution witnesses, 02 witnesses have already been examined and the trial is expected to be concluded within six months. Considering the aforesaid facts and circumstances and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Sessions Trial No. 401 of 2016, arising out of Khodawandpur P.S. Case No. 23 of 2016, pending in the court of the learned Additional Sessions Judge-IV, Begusarai.
The court below is directed to take all necessary steps to conclude the trial preferably within a period of six months from
Patna High Court Cr.Misc. No.19637 of 2017 (3) dt.10-05-2017 3/3 the date of receipt/production of copy of the order. The District Magistrate, Begusarai and the Superintendent of Police, Begusarai are also directed to ensure that during the trial the prosecution witnesses be produced on the date fixed by the court below so that the trial could be concluded within the stipulated period.
Let a copy of this order be communicated to the District Magistrate, Begusarai and the Superintendent of Police, Begusarai.
