Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Excise Case No. 230 of 2022, lodged under Section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, the total recovery of 20 liter of country-made liquor is the subject matter of the present case.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He also submits that 20 liter country-made mahua has been seized by

Patna High Court CR. MISC. No.54864 of 2022(2) dt.26-11-2022 2/2 the police and 100 k.g. jawa has been destroyed along with the container in which they used to prepare the alleged wine. Learned counsel further submits that petitioner is innocent lady having clean antecedent and she is in custody since 23.06.2022 and charge-sheet has already been filed in this case. Learned counsel also submits that there is gross violation of Section 100 of Cr.P.C. in this case.

Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-2nd-cum-1st Exclusive Special Judge, Excise, Saran at Chapra in connection with Excise Case No. 230 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
