JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.
It is alleged that the complainant and petitioner and other witnesses entered into the agreement to run the business of sale and purchase of land with a total capital of Rs.21,00000/-. The petitioner entered into the agreement with Meena Singh for the sale of 5.97 acres of land for a total consideration of Rs.35,00000/- but the petitioner failed to share the profit with other partners of the informant.
It is submitted by the learned counsel for the petitioner that the agreement between the petitioner and Meena Singh was
Patna High Court Cr.Misc. No.27200 of 2014 (4) dt.24-03-2015 2/2 executed on 29.3.2010 whereas the partnership firm was created on 1.9.2010.
Considering the fact that the agreement of the petitioner with Meena Singh is prior to the formation of partnership firm, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Civil Lines P.S. Case No. 648 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
