JUSTICE SANJAY PRIYA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Madanpur P.S. Case No. 229 of 2012 instituted for the offence under Section 395 of the Indian Penal Code.

The Fardbeyan is against unknown.

It is mentioned in the impugned order that name of this petitioner has come in the confessional statement of co-accused Jairam Singh in paragraph-68 of the case diary and, thereafter, confessional statement of this petitioner has been recorded in paragraph-74 of the case diary.

It has been submitted on behalf of the petitioner that Jairam Singh has already been granted bail by a coordinate Bench of this Court vide order dated 17.3.2016 passed in Cr. Misc. 8798

Patna High Court Cr.Misc. No.24402 of 2017 (2) dt.25-05-2017 2/2 of 2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 229 of 2012, subject to the condition that both the bailors will be the close relatives of the petitioner.
